WHEN A PERSON DIES, WHAT LEGAL SERVICES ARE NECESSARY, AND WHAT LEGAL SERVICES ARE MERELY OPTIONAL?
Necessary Legal Services
- Amend or transfer the title to a house or other real estate.
- Deal with large investments that are in the deceased's name alone.
Optional legal services
- Notify government offices, banks, creditors or others.
- Apply for life or other types of insurance proceeds or similar funds payable to named beneficiaries.
- Deal with small or joint investments.
- Handle any claims or matters, such as settlement or
litigation of disputes.
- Prepare a
new will or
powers of attorney.
- Obtain releases from beneficiaries of the estate or any other claimants.
- Ensure proper submission of all required income tax returns.
